Terms of Use
These Terms of Use (the "Terms") govern your use of the macOS application "ThroughView" (the "Software") provided by Quiet Tools (operated by Mao Sazaki) ("we", "us", or "our").
By installing or using the Software, you agree to these Terms.
1. License Grant
We grant you a non-exclusive, non-transferable right to use the Software in accordance with these Terms.
2. Device Limit
One purchase (license) allows use on up to two (2) Macs that you control.
3. License Verification & Offline Use
The Software may require an internet connection for license verification. After verification, the Software may continue to work offline for up to 30 days (depending on your environment and verification status).
4. Prohibited Conduct
You may not:
- - Copy, modify, reverse engineer, decompile, or disassemble the Software except to the extent permitted by applicable law.
- - Circumvent or attempt to bypass license verification or usage limits.
- - Redistribute, resell, rent, lease, or transfer the Software to any third party unless we explicitly permit it.
- - Use the Software for unlawful purposes.
5. Payments (Direct Sales)
For direct sales, payments are processed via Lemon Squeezy. Payment terms shown at checkout and Lemon Squeezy's terms may apply.
6. Refunds
Due to the nature of digital products, we generally do not offer refunds once access has been provided. However, we will issue a refund if:
- - A duplicate charge is confirmed, or
- - The Software remains unusable due to a technical defect despite reasonable troubleshooting, provided that:
- • your system meets the stated requirements, and
- • you contact us within 14 days of purchase.
Refunds are processed via Lemon Squeezy. We may refuse refunds in cases of suspected abuse or fraud. Please also refer to our Refund Policy.
7. Support
We provide support at our discretion. Response time and scope are not guaranteed. We may be unable to support issues caused by unsupported environments, OS updates, third-party software, or user modifications.
8. Disclaimer & Limitation of Liability
The Software is provided "as is". We do not warrant fitness for a particular purpose, accuracy, completeness, or uninterrupted operation.
To the maximum extent permitted by law, we are not liable for any damages arising from your use of the Software.
If liability cannot be excluded, our total liability will be limited to the amount you paid for the applicable purchase (for direct sales), except in cases of our willful misconduct or gross negligence.
9. Changes & Discontinuation
We may modify, update, or discontinue the Software at any time.
10. Intellectual Property
All intellectual property rights in the Software belong to us or the rightful licensors.
11. Changes to These Terms
We may update these Terms when necessary. Updated Terms take effect when posted on our website.
12. Governing Law & Jurisdiction
These Terms are governed by the laws of Japan. Any dispute shall be subject to the exclusive jurisdiction of the court having jurisdiction over our location in Japan, unless mandatory law provides otherwise.
